1. BINDING AGREEMENT AND ACCEPTANCE OF TERMS
These Terms of Service (the "Terms," "Agreement," or "ToS") constitute a legally binding agreement between you ("User," "you," or "your") and Ember and its operators, owners, employees, contractors, affiliates, partners, and service providers (collectively, "Ember," "we," "us," or "our") governing your access to and use of the Ember platform, website, mobile applications, and all related services (collectively, the "Service" or "Platform").
By creating an account, accessing, browsing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and your acceptance constitutes the organization's acceptance.
THESE TERMS CONTAIN IMPORTANT PROVISIONS INCLUDING AN ARBITRATION AGREEMENT, LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, AND INDEMNIFICATION OBLIGATIONS THAT AFFECT YOUR LEGAL RIGHTS. PLEASE REVIEW THEM CAREFULLY.
2. DESCRIPTION OF SERVICE
Ember is a faith-based digital platform that provides various features including but not limited to: daily devotional content, Bible study resources, prayer community features, spiritual reflection tools, and an artificial intelligence-powered conversation feature called "Bible Chat" or "Em" (the "AI Service"). The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind.
The Service is intended solely for personal, non-commercial use for spiritual growth, biblical exploration, and faith community engagement. Ember reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice or liability.
3. USER ACCOUNTS AND RESPONSIBILITIES
3.1 Account Creation: To access certain features, you must create an account by providing accurate, current, and complete information. You represent and warrant that all information you provide is truthful and accurate and that you will maintain and update this information to keep it current.
3.2 Account Security: You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password. You agree to immediately notify Ember of any unauthorized use of your account or any other breach of security. Ember will not be liable for any loss or damage arising from your failure to comply with these security obligations.
3.3 Account Eligibility: You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
3.4 Account Activities: You are fully responsible for all activities that occur under your account, whether or not you authorized such activities. You agree to accept responsibility for all actions taken using your account.
4. BIBLE CHAT (AI SERVICE) - COMPREHENSIVE TERMS AND DISCLAIMERS

THE BIBLE CHAT FEATURE ("Em" or "AI Service") IS AN AUTOMATED ARTIFICIAL INTELLIGENCE TOOL. IT IS NOT A HUMAN. IT IS NOT A LICENSED PROFESSIONAL. BY USING THIS FEATURE, YOU ACCEPT ALL RISKS AND AGREE TO ALL DISCLAIMERS IN THIS SECTION.
4.1 Nature of the AI Service: Bible Chat, powered by artificial intelligence, is designed as a CONVERSATION FACILITATOR and REFLECTION PARTNER for spiritual exploration only. It operates through automated algorithms and does not involve human counselors, therapists, clergy, or any licensed professionals. The AI Service asks questions to facilitate your personal reflection on faith-related topics but does not and cannot provide advice, counseling, therapy, or professional guidance of any kind.
WHAT BIBLE CHAT IS:
- An AI-powered conversation tool for spiritual reflection and biblical exploration
- A reflection partner that asks questions to invite deeper thinking about your faith
- A resource for exploring Scripture and Christian teachings through automated responses
- An experimental technology subject to errors, inaccuracies, and limitations
WHAT BIBLE CHAT IS ABSOLUTELY NOT:
- NOT a substitute for professional counseling, psychotherapy, or mental health treatment
- NOT a replacement for medical advice, diagnosis, or treatment from licensed healthcare providers
- NOT a substitute for legal, financial, or professional advice from qualified professionals
- NOT a replacement for pastoral care, spiritual direction, or counseling from trained clergy or spiritual leaders
- NOT qualified or licensed to provide any form of professional services, advice, or treatment
- NOT appropriate for crisis intervention, suicide prevention, or emergency situations
- NOT a licensed therapist, counselor, psychologist, psychiatrist, social worker, doctor, lawyer, or any other professional
- NOT capable of establishing a therapeutic relationship, professional-client relationship, or duty of care
- NOT monitored, supervised, or reviewed by licensed professionals in real-time
- NOT a reliable source of factual information, medical guidance, or professional consultation
4.2 AI Limitations and Risks: You acknowledge and understand that:
- The AI Service is powered by machine learning algorithms that can and will make mistakes, provide inaccurate information, generate inappropriate responses, misunderstand context, or fail to recognize serious situations
- AI-generated content should never be relied upon as factual, accurate, complete, or appropriate for your specific situation
- The AI Service cannot understand the full context of your life, cannot assess your mental state, cannot diagnose conditions, and cannot determine what help you actually need
- The AI Service has no judgment, wisdom, discernment, or professional training despite appearing conversational
- Responses are generated by algorithms based on patterns in training data and do not constitute professional opinions, advice, or guidance from any qualified individual
- The AI Service cannot and does not replace human connection, professional expertise, or qualified guidance
4.3 Mandatory Professional Referrals: YOU MUST SEEK HELP FROM QUALIFIED LICENSED PROFESSIONALS FOR:
- Mental Health: Depression, anxiety, trauma, PTSD, bipolar disorder, eating disorders, substance abuse, addiction, suicidal thoughts, self-harm, or any psychological or psychiatric condition
- Crisis Situations: Thoughts of suicide, self-harm, harming others, abuse, domestic violence, or any emergency
- Medical: Physical health concerns, symptoms, diagnosis, treatment, medications, or healthcare decisions
- Legal: Legal matters, rights, obligations, contracts, disputes, or any situation requiring legal advice
- Financial: Financial planning, investments, debt management, bankruptcy, or financial advice
- Relationship/Family: Marriage counseling, family therapy, conflict resolution, divorce, custody, or abuse
- Pastoral/Spiritual: Complex theological questions, spiritual direction, religious counseling, or pastoral care requiring trained clergy or spiritual advisors

DO NOT rely on Bible Chat for help in any emergency or crisis situation. The AI cannot help you in these situations and using it instead of getting real help could result in serious harm or death.
4.4 No Professional Relationship or Duty of Care: Use of Bible Chat does not create any professional relationship, therapeutic alliance, counselor-client relationship, doctor-patient relationship, attorney-client relationship, spiritual director-directee relationship, or any other form of professional relationship between you and Ember, its operators, employees, contractors, or any affiliated parties. No duty of care, fiduciary duty, or professional obligation of any kind is created by your use of the AI Service.
4.5 User Assumption of Risk: BY USING BIBLE CHAT, YOU EXPLICITLY ACKNOWLEDGE, UNDERSTAND, AND AGREE THAT:
- You are using the AI Service entirely at your own risk
- You will not rely on AI-generated content for any important decisions, professional matters, or personal well-being
- You will immediately seek qualified professional help for any serious concerns or situations requiring expertise
- You understand the AI has no qualifications, cannot assess your needs, and cannot determine what help you require
- You will not use Bible Chat as a substitute for professional services of any kind
- You accept full personal responsibility for your decisions, actions, and well-being
- You will verify any information provided by the AI with qualified sources before relying on it
4.6 Monitoring and Automated Safety Features: While Ember employs automated systems to detect concerning content and provide crisis resources, these systems are limited, imperfect, and cannot be relied upon. These safety features do not constitute professional assessment, intervention, or care. They are automated responses that may fail to detect serious situations or may trigger inappropriately. You cannot and must not rely on these automated systems for your safety or well-being.
5. COMPREHENSIVE DISCLAIMER OF WARRANTIES
THE SERVICE, INCLUDING ALL CONTENT, FEATURES, AND FUNCTIONALITY, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EMBER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, ACCURACY, AND QUALITY. EMBER DOES NOT WARRANT THAT:
- The Service will meet your requirements or expectations
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Service will be accurate, reliable, or complete
- The quality of any content, information, or other material obtained through the Service will meet your expectations
- Any errors in the Service will be corrected
- The AI Service will provide accurate, appropriate, safe, or helpful responses
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM EMBER OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
6. COMPREHENSIVE LIMITATION OF LIABILITY AND INDEMNIFICATION
COMPLETE RELEASE OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EMBER, ITS OPERATORS, OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, SERVICE PROVIDERS, LICENSORS, SUCCESSORS, OR ASSIGNS (COLLECTIVELY, THE "RELEASED PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:
- Direct, indirect, incidental, special, consequential, exemplary, or punitive damages
- Personal injury, wrongful death, emotional distress, or psychological harm
- Loss of profits, revenue, business, data, or anticipated savings
- Loss of use, goodwill, or reputation
- Costs of procurement of substitute goods or services
- Damages arising from your reliance on any content, advice, or information provided through the Service
- Damages arising from decisions made based on AI-generated content
- Damages arising from failure to seek or delay in seeking professional help
- Any other damages or losses of any kind, whether foreseeable or unforeseeable
THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING BUT NOT LIMITED TO CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, WARRANTY, OR ANY OTHER THEORY, AND WHETHER OR NOT THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SPECIFICALLY WITH RESPECT TO BIBLE CHAT: THE RELEASED PARTIES SHALL HAVE ABSOLUTELY NO LIABILITY FOR ANY CONTENT, RESPONSES, ADVICE, INFORMATION, OR OUTPUT GENERATED BY THE AI SERVICE, INCLUDING BUT NOT LIMITED TO ANY INACCURACIES, ERRORS, OMISSIONS, INAPPROPRIATE RESPONSES, HARMFUL ADVICE, OR FAILURE TO DETECT CRISIS SITUATIONS. YOU ACKNOWLEDGE THAT YOU USE BIBLE CHAT ENTIRELY AT YOUR OWN RISK AND THAT THE RELEASED PARTIES BEAR NO RESPONSIBILITY WHATSOEVER FOR ANY CONSEQUENCES ARISING FROM YOUR USE OF OR RELIANCE ON THE AI SERVICE.
IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SERVICE OR WITH THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. IN SUCH JURISDICTIONS, THE RELEASED PARTIES' LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
6.1 Indemnification: You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney's fees) arising from: (a) your use of or inability to use the Service; (b) your violation of these Terms; (c) your violation of any third party rights, including intellectual property rights; (d) any decisions or actions taken based on content from the Service; (e) any content you submit or transmit through the Service; or (f) your reliance on AI-generated content.
6.2 Cap on Liability: IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE RELEASED PARTIES TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE AMOUNT YOU PAID TO EMBER, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS LESS.
7. DISPUTE RESOLUTION AND ARBITRATION AGREEMENT
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
7.1 Informal Dispute Resolution: In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, you agree to first contact Ember at [email protected] to attempt to resolve the dispute informally for at least thirty (30) days before initiating any formal proceedings.
7.2 Binding Arbitration: If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be finally settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and judgment on the arbitration award may be entered in any court having jurisdiction.
7.3 Class Action Waiver: YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN YOU AND EMBER INDIVIDUALLY. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR OTHER REPRESENTATIVE ACTION.
8. INTELLECTUAL PROPERTY RIGHTS
All content, features, functionality, and materials available through the Service, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, software, and AI-generated content, are the property of Ember or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only, strictly in accordance with these Terms. This license does not include any right to reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any part of the Service without Ember's prior written permission.
9. USER CONDUCT AND PROHIBITED USES
You agree NOT to use the Service to:
- Violate any applicable federal, state, local, or international law or regulation
- Transmit any unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable content
- Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
- Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
- Use the Service for any illegal, fraudulent, or malicious purpose
- Attempt to use Bible Chat to obtain professional advice, diagnosis, treatment, or counseling of any kind
- Introduce any viruses, trojan horses, worms, logic bombs, or other malicious or technologically harmful material
- Collect or harvest any personally identifiable information from other users
- Interfere with or disrupt the Service or servers or networks connected to the Service
Violation of these provisions may result in immediate termination of your account and access to the Service, and may subject you to civil and criminal liability.
10. TERMINATION
Ember reserves the right, in its sole discretion, to terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice, and without liability. Grounds for termination may include, but are not limited to, violation of these Terms, fraudulent or illegal activity, prolonged inactivity, or any conduct that Ember deems harmful to the Service or other users.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. MODIFICATIONS TO TERMS AND SERVICE
Ember reserves the right, at its sole discretion, to modify, update, or replace these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Service, and your continued use of the Service after any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for changes.
Ember also reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, including features, functionality, or availability, without prior notice or liability.
12. PRIVACY AND DATA COLLECTION
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. Conversations with Bible Chat are processed to generate responses and monitor for safety concerns, but are not stored permanently or used for training purposes without your explicit consent.
13. THIRD-PARTY LINKS AND CONTENT
The Service may contain links to third-party websites, services, or resources. These links are provided for your convenience only. Ember has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Ember shall not be responsible or liable for any damage or loss caused by or in connection with the use of any third-party content, goods, or services.
14. SEVERABILITY AND WAIVER
If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining provisions shall continue in full force and effect.
No waiver by Ember of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by Ember to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
15. GOVERNING LAW AND JURISDICTION
These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the United States and the State of [Your State], without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within [Your County], [Your State], for the resolution of any disputes, except as provided in the Arbitration Agreement section.
16. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and any other legal notices or agreements published by Ember on the Service, constitute the entire agreement between you and Ember concerning your use of the Service and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

ACKNOWLEDGMENT OF UNDERSTANDING
BY CREATING AN ACCOUNT, CHECKING THE "I AGREE" BOX, OR USING THE SERVICE IN ANY WAY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE TO THE DISCLAIMERS, LIMITATIONS OF LIABILITY, AND TERMS REGARDING THE BIBLE CHAT AI SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICE.
